The Service uses artificial intelligence and machine learning technologies to generate content based on user inputs. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Eligibility and Account Registration

3.1 Age Requirements

• Similar or identical content may be generated for other users with similar inputs
• We do not claim ownership of Generated Content

You agree not to submit, upload, or input any User Content that:

4.4 Our Intellectual Property

• Damages resulting from your access to or use of or inability to access or use the Service
• Damages resulting from any conduct or content of any third party on the Service
• Damages resulting from unauthorized access, use, or alteration of your content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

• Your User Content or Generated Content
• Your violation of any third-party rights, including intellectual property rights
• Any harm caused to another user

11. Modifications to Service and Terms

11.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11.2 Terms Modifications

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations between the parties. If the dispute cannot be resolved through negotiation, you agree to first contact us at legal@personaplus.ai to attempt to resolve the dispute informally.

12.3 Arbitration

If informal dispute resolution is unsuccessful, any remaining disputes shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction.

12.4 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and you waive any right to participate in a class-action lawsuit or class-wide arbitration.

The Service is controlled and operated from our facilities in the United States. We make no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own risk and are responsible for compliance with local laws.

14. Termination

These Terms remain in full force and effect while you use the Service. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• Sections of these Terms that by their nature should survive termination shall survive

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent and economic effect of the invalid provision.

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and Persona Plus regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
